1. Acceptance of Terms
These Terms and Conditions govern your use of the services provided by Black Virgin Studio via our website. By booking or purchasing services, you agree to be bound by these terms.
2. Services Provided
We offer audio services including mixing, mastering, instrument recordings, music production and full song arrangements, delivered digitally unless otherwise specified.
3. User Responsibilities
You agree to provide clear instructions, necessary materials (e.g. lyrics, demos), and timely feedback during the production process.
4. Booking and Availability
All services are subject to availability. Turnaround times depend on the service booked and will be communicated upon confirmation.
5. Pricing
Prices are listed on our website or discussed per project. All prices include applicable taxes unless stated otherwise.
6. Payment Terms
Full payment is generally required upfront to secure booking. Payment methods include credit card, PayPal, or other options specified at checkout.
7. Booking, Payment, Cancellations & Refunds
- Custom Services
Our services are personalized and made-to-order. Under EU consumer law, such services are exempt from the 14-day right of withdrawal if the customer consents to the service beginning immediately.
By booking with us, you agree that:
Work may begin immediately upon payment
You waive your right to cancellation once work has begun
- Cancellations
Before work begins: A full refund is available if the order is canceled within 14 days of initial purchase.
After work begins: Refunds are not guaranteed and are handled on a case-by-case basis, depending on the progress made.
Dissatisfaction: Creative services are subjective. We ensure you are fully satisfied by a clear communication upfront and offer up to 2 free revisions; with the option to add more (see below); however, refunds after delivery of agreed services are not guaranteed.
- Revisions
2 free revisions are included. Additional changes may be billed separately at an hourly or fixed rate.
- PayPal & Payment Disputes
If you pay via PayPal or similar platforms, you agree to contact Black Virgin Studio first in the event of an issue. Opening a dispute or chargeback without attempting to resolve the matter directly may be considered a breach of contract.
We provide proof of service delivery and reserve the right to contest any unjustified claims through those platforms.
8. Delivery of Services
Files are delivered digitally through email, download links, or platforms like WeTransfer or Google Drive. Delivery times vary depending on the scope of the service.
9. Limitation of Liability
We are not liable for any damages or loss resulting from the use of our services or files once delivered, including commercial use. All files should be backed up by the client upon delivery.
You are solely responsible for the accuracy of the metadata and information you provide. We cannot be held liable for any issues resulting from incomplete or incorrect information, including rights, credits, or samples.
10. Confidentiality & Data Protection
Your personal data is handled in accordance with our Privacy Policy. Audio files and project details remain confidential unless otherwise agreed.
11. Copyright & Ownership of Work
Session Work / Recordings
For basic session services (e.g. recording guitar or any other instrument parts, mixing, mastering, vocal tuning), full rights to the final audio are transferred to the client upon full payment. Black Virgin Studio retains no claim to copyright or authorship.
Full Arrangements & Custom Productions
For full song productions or custom arrangements where we contribute creatively in a signifiant way to the musical composition or structure:
Black Virgin Studio retains the right to be credited as co-composer or arranger.
We may claim up to 20% of the composition or arrangement rights, unless otherwise agreed in writing.
These rights must be declared during registration with copyright societies (e.g. SACEM, ASCAP, BMI).
By commissioning such services, you agree to register our contribution accordingly, as required by your performing rights organization.
Clients are responsible for ensuring that Black Virgin Studio (or its designated representative) is credited appropriately where due.
12. Jurisdiction
These terms are governed by French and European Union law. Any disputes shall be resolved under the jurisdiction of the courts located in France.
